1. Who these terms are with
These Terms and Conditions govern your use of hoverai.au and the services provided by Hover Aerial Imaging (ABN 24 352 655 977) of Brisbane, Queensland. In these terms, "Hover", "we" and "us" mean Hover Aerial Imaging, and "you" means the person or organisation engaging us.
Hover is a specialist single-operator practice. Harry Billing, Owner and Chief Remote Pilot, plans and flies every engagement personally. Work is not subcontracted to a pilot network.
Where a written proposal has been issued for your project, that proposal and its stated scope, exclusions and commercial terms take precedence over this page to the extent of any inconsistency. Where a signed contract or client-side services agreement is in place, that document takes precedence over both.
2. What we provide
Drone photogrammetry and LOD 400 digital twins · AI-assisted defect detection · topographic site surveys · volumetric and stockpile surveys · close visual inspections of bridges, towers, dams, roofs and facades · aerial photography and videography.
All capture is by photogrammetry. Hover does not operate LiDAR. Where a project genuinely requires LiDAR we say so at quoting rather than substitute a method that won't meet the brief.
3. Quotes, scope and acceptance
We issue a written proposal setting out the scope, method, deliverables, accuracy specification, exclusions and a fixed price. Quotations are valid for 30 days from the date of issue.
Acceptance is by purchase order or written confirmation, including a signed copy of the proposal returned by email. On receipt we issue the Preliminary Site Assessment and propose mobilisation dates within five business days.
The proposal defines the scope. Work outside it is a variation, quoted and agreed in writing before it is carried out.
4. Your obligations
- Arrange site access and any security inductions. Up to one hour is allowed for client site induction; longer inductions are treated as a delay under clause 7.
- Disclose known hazards, including overhead services, live plant, restricted areas and any asset condition affecting flight safety.
- Obtain any landholder or asset-owner permission we don't hold ourselves.
- Nominate a site contact for the capture window.
- Tell us of any third-party requirements — client SWMS templates, prequalification systems, insurance certificates — before mobilisation.
5. Flight operations, safety and compliance
Hover holds CASA Remote Operator Certificate (ReOC) #9398 and operates under CASR Part 101 and a documented Operations Manual. The Chief Remote Pilot holds a current Remote Pilot Licence (RePL) and Aeronautical Radio Operator Certificate, with recurrent training logged against the Operations Manual.
For each engagement:
- a Preliminary Site Assessment is filed before mobilisation, covering airspace classification, controlled-airspace clearances, third-party hazards, ground egress and stakeholder notification
- a Specific Flight Assessment is filed within 24 hours of capture, covering weather, NOTAMs, wind and visibility limits, fitness to fly and the final go/no-go decision
- Job Safety Analysis and site-specific flight documentation are issued to your safety team in advance of mobilisation. SWMS is provided where required by you or the site.
Hover manages regulatory approvals, CASA authorisations and exclusion-zone applications for the scoped works, and their cost is included in the quoted price unless a material scope change arises after commencement.
Operations are scoped between 0600 and 1800 on the planned capture day. After-hours capture is available on request at an agreed premium, flown under Hover's night VLOS approval and limited to photography and video; visual survey, inspection and mapping cannot operate outside these hours because of lighting limitations.
No operations are conducted over unprotected personnel. The remote pilot operates from a safe ground position, maintains separation from anyone not part of the operation, and has final authority over whether a flight proceeds.
6. Accuracy, the accuracy gate and what the data is for
Survey deliverables are issued against an accuracy gate set for the engagement. The tolerances that apply to your job, which typically cover ground-control residuals, independent check-point Z-RMSE, the maximum permitted single check-point error, aerotriangulation reprojection error and, where a close-standoff inspection flight is scoped, detailed inspection ground sample distance, are stated in the proposal before capture and confirmed in the Survey Quality Report that accompanies the deliverable.
If the gate is not met, Hover re-marks ground control and re-runs the aerotriangulation. If residuals still fail, the site is re-flown at no additional cost to you. Data that fails the gate is not issued.
Ground control is established to suit the site, with a minimum of three control points and two independent check points, and more where size or layout require it. The check points are withheld from the bundle adjustment and used as the independent audit gate against which the survey is judged.
Achieved accuracy depends on ground control, satellite geometry, surface texture, lighting, vegetation and site conditions, and figures above are targets confirmed per job rather than guarantees for every capture. Deviations, if any, are recorded in the Survey Quality Report.
Hover data is engineering and asset-management data supporting design, quantity, condition and planning workflows. It is not a legal or cadastral survey.
Close visual inspections build no 3D model unless separately scoped. A close visual inspection delivers referenced photographs and video, reviewed by your inspector live or afterwards, with a PDF report on request. AI-assisted defect detection is the service that delivers the geolocated inspection report, the 3D model and the defect register.
Deliverables record the asset as captured on the capture date. They do not warrant the structural condition, safety or fitness for purpose of any asset.
7. Delivery, delays and weather
Processed deliverables are issued within two to three business days of capture for standard scopes, and up to five business days for large or complex models. Where a different timeframe applies it is stated in the proposal.
Inclement weather. Hover monitors conditions in the days before capture. If weather prevents flight, pre-mobilisation fees remain payable in full; on-site capture, processing and optional inclusions are not payable if the flight does not proceed. A rescheduled date is offered at no additional fee.
Delays beyond Hover's control. Where operations are delayed by site-access issues, third-party activity or safety-mandated pauses, the full quoted rate remains applicable. Delays are documented in the Flight Record, and time beyond the quoted hours is billed at $160.00 per hour.
8. Interpretation of findings
Findings, defect identifications and condition observations are capture and detection outputs, not engineering determinations.
AI-assisted defect detection identifies and measures candidate defects. Every AI detection is manually verified by a Hover inspector before delivery — automated vision routinely returns a significant proportion of false positives on real infrastructure, and unverified output is not issued. Verification confirms severity ratings, dimensions and recommended actions on every flagged feature.
Detection does not classify structural adequacy, determine cause or constitute a recommendation to act. Every output is for review by a suitably qualified engineer or inspector, who remains responsible for the engineering judgement drawn from it.
Drone capture removes the need to put people on a structure for many inspection tasks. It does not replace a hands-on inspection where one is required by a standard, a regulator or the asset owner.
9. Fees and payment
All figures are quoted in Australian dollars and are exclusive of GST unless stated otherwise. GST is shown separately on the invoice. Indicative price ranges published on hoverai.au are likewise exclusive of GST and are guides rather than quotes.
- Payment terms: EFT within 30 days of a correctly rendered tax invoice.
- Payment schedule: 100% invoiced on completion of the project, payable per the terms above. No deposit is required.
- Travel, mobilisation and regional logistics are included in the quoted fixed price unless the proposal states otherwise.
Unless the proposal states otherwise, the following are excluded and arranged or borne by you: site access and security inductions; survey-control work outside the scoped site footprint, including off-site ties to State Survey marks; out-of-hours operations; and additional defect re-inspections, longitudinal change-detection captures or follow-up site visits beyond the scoped works.
Cancellation. If you cancel before we have begun pre-mobilisation work, nothing is payable.
If you cancel after we have begun pre-mobilisation work — regulatory approvals, Job Safety Analysis preparation, flight-path development, data-management planning or establishment of survey control — the project management and mobilisation component of the quoted fee is payable, and the capture and processing components are not.
If you cancel on the planned capture day, or after mobilisation to site has begun, the full quoted fee is payable.
Where a project is postponed rather than cancelled, no cancellation fee applies and the quoted price is held for 30 days from the original capture date.
10. Intellectual property and licence
Hover retains ownership of its methodology, flight plans, processing workflows, software configuration and any raw capture data not forming part of the agreed deliverables.
On payment in full you receive a perpetual, non-exclusive, transferable licence to use, copy, modify and share the final processed deliverables — reports, 3D models, point clouds, orthomosaics, surface models, defect registers, imagery and video — for the project they were captured for and for the ongoing management of that asset.
Retention. Raw imagery, EXIF, RTK logs and processing project files are retained for a minimum of three years from delivery and are available for audit at any time during that period. Extended retention is available at additional cost.
Hover may use non-identifying imagery, models and capture data for portfolio, marketing and service-development purposes. We will not identify you, your site or your project without your written agreement, and will not publish anything you tell us is commercially sensitive. Tell us at any time and we'll remove it.
11. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited under the Australian Consumer Law, it is limited, at our option, to resupplying the services or paying the cost of having them resupplied.
Subject to the above, and to the maximum extent permitted by law:
- our total aggregate liability arising out of or in connection with an engagement — whether in contract, in tort (including negligence), under statute, or under the indemnity in clause 12 — is limited to the total fees paid by you for that engagement
- we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of contract, project delay costs, or loss arising from decisions made in reliance on deliverables without the qualified review described in clause 8
- we are not liable for loss arising from information you gave us that was incomplete or inaccurate, or from site conditions not disclosed to us
We hold $28,000,000 public liability cover — comprehensive aviation liability covering accidental bodily injury and property damage arising from RPAS operations — for every flight conducted under our ReOC. A certificate of currency is supplied before mobilisation as standard.
12. Indemnity
You indemnify us against claims arising from your use of deliverables outside the scope they were captured for, your failure to disclose a site hazard, or your breach of these terms — except to the extent the claim arises from our own negligence or breach.
This indemnity is subject to the limitation of liability in clause 11.
13. Confidentiality
We treat your project information as confidential and will not disclose it to third parties except as needed to deliver the work, or as required by law. The portfolio permission in clause 10 is the one exception and operates only on the non-identifying basis described there.
14. Website use
Content on hoverai.au is general information. Indicative price ranges published on the site are guides only and are not offers — every job is scoped and quoted individually. You may not scrape, republish or resell site content commercially without permission. Automated agents may read this site and its published machine-readable interfaces (/llms.txt, /.well-known/, /md/) as those interfaces describe.
15. Suspension and termination
Either party may terminate in writing. If you terminate after work has begun, you pay for work performed and costs committed to that point. We may suspend or terminate if a site cannot be made safe, if a required approval is refused, or if invoices remain unpaid beyond the terms in clause 9.
16. General
Governing law. Queensland, Australia. Both parties submit to the exclusive jurisdiction of the courts of Queensland.
Severability. If any provision is unenforceable, the rest continues in force. Variation. We may update these terms. The version published here when you accept a proposal is the version that applies to that engagement. No waiver. A failure to enforce a term is not a waiver of it. Force majeure. Neither party is liable for delay caused by events beyond reasonable control, including weather, airspace closure, regulatory direction or site shutdown.
